THE ABUSE OF PRISONERS' RIGHTS IN NIGERIA IS CAUSED BY VARIETY OF FACTORS TO WIT
(ebsu repository office, 2022-02-20) IGWE ONYEBUCHI IGWE
Prisoners are those who are lawfully committed to the Prison custody. One of the purposes of imprisonment is to protect society and reform those who are involved in crime. Although, prisoners are cut off from the out side world, they a re still human beings who are entitled to all the rights of free citizens save those withdrawn from them by law, expressly or by implication, or those inconsistent with the legitimate penalogical objectives of the prison system. During the colonial base in Nigeria, the rights of prisoners appeared to be more respected than in recent time particularly after the Nigerian Civil War when the rate of crimes increased. The result is that those in the Nigerian Prisons today stand little chance of their rights being respected. Those without money even stand a lesser chance. This research reviewed that the abuse of prisoners' rights in Nigeria is caused by variety of factors to wit: lacunae in laws on prisons, the overuse of imprisonment in Nigeria, insufficient funding of prisons by the Federal Government, high rate of inmates on remand, poverty among prisoners, the fact that police often fails to transmit case files to the Ministry of Justice, constant asking for adjournment by lawyers, etc. It is based on the above that we made our recommendations.
